"The quesiton is focused on driving in the UK for an extended period of time without taking a UK driving test. UK nationals have to take a test. Non-EU residents must take a driving test after 1 year driving in this country. Is this rule for people from the EU a good one.".

Yes - they have passed their driving test in their EU origin country and that should ok for UK driving - no need to take a UK driving test.
